Thank you for your interest in participating as an organization at Be Well Farmers’ Market! Our market offers a welcoming space for organizations to promote their mission and connect with local community members.

Be Well Farmers’ Market is a creative urban market where local sustainable farmers, growers, Makers and wellness practitioners come together. Our market is based on a passion for healthy living, fresh food, community well-being, and local entrepreneurship.

What makes our market unique? It’s our live music, food trucks and a family-friendly atmosphere. Outdoor seating, and beautiful community garden spaces, all of this creates a one-of-a-kind market experience.

MARKET LOCATION, HOURS, AND GENERAL INFORMATION

This year while the Be Well Farmers Market Pavilion is under construction our market will be at Ratio Park, directly across the street from the Be Well Café at 2027 Salisbury St., St. Louis, MO .

Our market season starts Wednesday, May 29th 5:00 pm – 7:00 pm and monthly on the last Wednesday of the month thru October 30th.

Be Well Farmers’ Market is open rain-or-shine. Our commitment to customers and vendors is to be open during the days and hours we have published. In the event of extreme inclement weather or other emergencies, we will email or text you as early as possible to notify you of any changes to our market hours.

2024 MARKET FEES AND DEPOSITS

There is NO COST for non-profit organizations to participate at Be Well Farmers’ Market.

MARKET ABSENCE POLICY

Vendors, if you have an emergency and cannot attend contact Uzair via email at Uzair.bewellcafestl@gmail.com. No refunds for cancellation.

MARKET SET-UP AND BREAK-DOWN INFORMATION

Set-up is on market days only.
Organizations may arrive as early as 4:00 pm to set up.
Organizations must have their booth space cleaned and all materials removed by 7:30 pm

MARKET RULES & LEGAL REQUIREMENTS

Organizations are required to complete and sign a Be Well Liability Waiver.
Organizations are required and responsible for following all health, tax, special permits and/or licensing requirements to do business in the City of St. Louis.
No alcoholic beverages or marijuana will be allowed on the premises.
No smoking on any of our parcels.

MARKET SIGNAGE, MATERIALS & CROSS-MARKETING REQUIREMENTS

Professional, visually-appealing booth presentation is a requirement for our market. Organizations are required to bring tablecloths, signage with their organization name, and any additional materials they choose to promote their community services.

Organizations are required to participate in our cross-marketing campaign. Organizations must include the date, time, and location of Be Well Farmers’ Market in their cross-marketing posts. Posts should be shared through social media, company web pages, or other preferred methods for communicating with customers. Be Well Café will publicize organizations and their presence at the market through the Be Well Café website, Instagram, and Facebook page.

VENDOR LIABILITY WAIVER

THIS VENDOR LIABILITY WAIVER (“Waiver”) is entered into effective as of the date of signature in consideration for you (“Releasor” or “Vendor”) receiving permission to enter, rent, lease, license, occupy or otherwise make use of selling space (the “Farmers Market Space”) at BE WELL CAFÉ (the “ Farmers Market”) operated by Be Well Café a nonprofit public benefit corporation (“Be Well Café).

AGREEMENT

1. General Release. In consideration of Be Well Café granting me the right to use the Farmers Market Space, located at 2029 and/or 2030 Salisbury St., St. Louis, MO 63107 I, for myself, my employees, agents, representatives, and assigns, hereby release and hold harmless Be Well Café , and its contractors, directors, officers, employees, agents, representatives and assigns (“Releasees”), from all claims of negligence resulting in personal injury, accident, illness (including death) or property damage arising from or relating to my participation in the Farmers Market and use of the Farmers Market Space.

2. Assumption of Risk. In executing this release, I acknowledge that participation in the Farmers Market and use of the Farmers Market Space carries certain inherent dangers that cannot readily be eliminated regardless of the care taken to prevent and avoid injury, and hereby additionally assume the risk of liability for injury, accident, or illness, including death, resulting from such dangers. These dangers include, without limitation, heavy lifting, falling objects, exposure to hazardous materials or equipment, exposed wires, moving vehicles, and uneven footing, as well as general risks including, but not limited to slips, trips, falls, cuts, adverse weather conditions, falling trees or branches, and the acts or omissions of Farmers Market customers or vendors or other members of the public. I understand that the description of the risks in this Waiver is not complete and that other risks or events arising from participation in the Farmers Market or use of the Farmers Market Space, both known or unknown, anticipated or unanticipated, may result in serious bodily injury, death, or property damage.

3. Indemnification. I agree to indemnify and defend Releases, through their own choice of counsel, against any and all claims arising out of or related to the negligent or intentional acts or omissions of myself, my employees, agents, representatives or assigns in connection with my participation in the Farmers Farmers Market or use of the Farmers Market Space, including any acts or omissions undertaken in contravention of Be Well Cafés Rules and Regulations.

4. Compliance with Laws. I agree to obey all laws, ordinances, rules and regulations adopted or established by Federal, State, or local governmental agencies or bodies while participating in the Farmers Market or using the Farmers Market Space.

5. Media Release. In further consideration for my use of the Farmers Market Space, I authorize Be Well Cafe the use of my likeness or identifying information in any publications or publicity materials, including but not limited to, books, internet and web content, newsletters, newspapers, and other means of advertising, without any compensation or fee being paid.

6. Choice of Law. I agree that any dispute concerning this Waiver will be governed by the laws of the State of Missouri and that the exclusive venue for any dispute that may arise out of this Agreement will be in St. Louis, Missouri. If any clause or provision of this Waiver is held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision will not otherwise affect the remaining provisions of this Agreement, which will continue to be enforceable.

7. I HEREBY AFFIRM THAT I AM EIGHTEEN (18) YEARS OF AGE OR OLDER, I HAVE READ THIS WAIVER, I AM FREELY AND KNOWINGLY AGREEING TO ALL OF THE PROVISIONS OF THIS WAIVER, AND I UNDERSTAND AND AGREE TO BE BOUND BY THE TERMS OF THE WAIVER.
